Tamarack Defense End User License Agreement

You and Tamarack Defense (“TD”) agree to the terms of this End User License Agreement. The terms of this agreement take effect when you purchase any product or service from TD, whether directly or through TD’s partnership with DACIS.

1.      Ownership and Use of TD Products and Services

TD owns all right, title, and interest in the TD products and services except for the rights expressly granted to you in this agreement. Subject to the terms of this agreement, including any related order forms or statements of work, TD grants you the non-exclusive, non-transferable, limited right to access and use the products and services during the term of your paid subscription for internal business purposes only. TD permits you to create reports or presentations using excerpts of the information contained in the TD products or services provided the use is for internal business purposes only and credits TD as the source of the excerpted information.

You are responsible for all activity occurring under your account and for complying with all laws and regulations applicable to your use of the products or services. You shall not use the TD products or services for any unlawful, harmful, or offensive purpose. Except as otherwise permitted by the terms of this agreement, you may not a) use, copy, modify, sublicense, transfer, sell or otherwise commercially exploit the TD products or services; b) modify or create derivative works of the products or services; c) reverse engineer the products or services; d) gain unauthorized access to the products or services; or e) interfere with or disrupt the performance of the products or services.

2.      Limited Warranty and Disclaimer

TD warrants only that its products and services were produced in a professional manner, consistent with industry standards, at the time they were created. Because the creation of TD’s products and services requires making uncertain predictions and estimates, TD disclaims all responsibility for losses or damages you incur as a result of your reliance on the information contained in the TD products or services.

Except for the limited warranty provided in this agreement, TD provides its products and services “as is” and does not warrant the completeness or accuracy of the data, material, or information contained in the products or services or that they will satisfy your requirements. TD expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
